It aims to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all disabled people. The convention was ratified by the UK in 2009, including the Optional Protocol that allows individuals who believe that their convention rights have been breached, to bring complaints to the UN Disability Committee. The committee can also undertake enquiries into alleged grave or systematic violations of the convention. Despite ratification, the government have yet to incorporate, in full the convention into domestic law. In August 2017, the UN Committee on the Rights of Persons with Disabilities (CRPD Committee) examined the extent to which the UK and devolved governments comply with the convention. Several failings were identified and the CRPD Committees main concerns and recommendations to the UK government are set out in its concluding observations and can be found here HYPERLINK "/equality" \t "_blank"/equality. Update: Government is accused of hiding from the UN over the treatment of disabled people The much-anticipated examination by the UN Committee responsible for monitoring the UNCRPD was met with a refusal by the UK government in August 2023, to meet the UN committee, to address the failings identified and the main concerns and recommendations made in August 2017. Instead, the UK government have said that they will not give evidence until March 2024. The CRPD confirmed that the interaction between the State party and the Committee had been postponed, but it declined to comment on the UK governments decision. The refusal to meet with the committee was met with great disappointment by a coalition of Disabled People and Disabled Peoples Organisations (DPOs), who had worked tirelessly in gathering evidence for the production of a shadow report on the governments progress since 2016. Without the full incorporation of the UNCRPD, disabled peoples rights will continue to be eroded, which is why, along with the TUC and wider trade union movement and Disabled Peoples Organisations (DPOs), are calling for: FULL implementation of the UNCRPD into domestic law MANDATORY disability employment pay gap reporting with a change in legislation that places a duty on employers to produce targeted action plans to identify the steps they will take to address any gaps WORKPLACE ADJUSTMENTS to be made within two weeks, along with the option to work flexibly from day one, as a legal default for all jobs. In the run-up to the next election, we are asking every political party standing to make this a central feature of your manifestos and to commit to coproducing policies for disability equality with our representative Deaf and Disabled Peoples organisations (DDPOs). This is an urgent task as Disabled peoples rights, living standards and independent living are all under attack. Successive Governments since 2010 have pursued policies which led the UN Disability Committee to declare in 2016 that grave and systematic rights violations had taken place. A new shadow report compiled as written evidence for a follow-up by the Committee describes how disabled peoples living standards have deteriorated further since 2016. Continued cuts to support for disabled people living in the community have led to us becoming segregated away from society from within our own homes. In England, more than one in four (28%) people who had asked for a social care assessment had been waiting six months or more to get one./ Delayed assessments have helped to precipitate a situation in which an estimated 2.6 million people in England aged over 50 are now living with some unmet need for care. That means millions struggling to do ordinary things like going to the toilet, eating, dressing or washing because they require some help to do so. I have outlined below examples of how disabled people are being treated and hope that this reflects the change we need to see, the change that starts with the full incorporation of the UNCRPD. Employment and the disability pay gap Disabled workers are more likely to be in part-time work, in lower-paid jobs and insecure work. The pay gap between non-disabled and disabled workers is now 14.6% with Disabled women facing an even bigger pay penalty of 30% - 3.73 an hour. TUC analysis reveals that the pay gap for disabled workers across the board is 1.90 an hour, or 66.50 per week over what the average household spends on their weekly food shop. This makes for a pay difference of 3,460 a year for someone working a 35-hour week and means that disabled people effectively work for free for the last 47 days of the year! The pay gap is also linked to unlawful discrimination, a lack of access to flexible working, and employers failing to provide reasonable adjustments, which are not a perk, but a necessity for disabled workers. Furthermore, the analysis shows that Disabled workers are more likely than non-disabled workers to be on zero-hours contracts (4.5% to 3.4%) and disabled BME women are nearly three times as likely as non-disabled white men (6.0% to 2.2%) to be on these insecure contracts. This is why we are calling for a ban on zero-hour contracts to stop insecure work, along with mandatory disability and ethnicity pay gap reporting with a change in legislation that places a duty on employers to produce targeted action plans to identify the steps they will take to address any gaps Impact of the cost-of-living crisis A recent report by a disabled people-led Commission in Lewisham found that 20% of respondents didnt always have access to food and drink, could not wash (or be washed) regularly and couldnt go to the toilet when needed. Health and social care Continued cuts to support for disabled people living in the community have led to disabled people becoming segregated away from society from within their own homes. While being included in the community is much more than social care it is the crisis in social care which dominates our lives. It is the major factor that is killing Disabled people disproportionately to the rest of the UK population. Disabled people are dying on waiting lists, either waiting to be assessed or waiting for services. These deaths are caused by ongoing cuts to state support over the last 13 years. According to Age UK, 28,890 older Disabled people died in 2021/22, the latest year for which figures are available, without ever receiving the care and support they were waiting for. This equates to 79 deaths a day, 554 a week, and 2408 a month. Local authorities are planning another 2.5 billion cuts over the next 2 years including social care cuts of 467 million, which will exacerbate this already dire situation. The UK Government signed and ratified the CRPD in 2008 but has failed to incorporate its articles into UK law, leaving its implementation trapped on paper. If the rights enshrined in the Convention are to be realised then it needs to pass onto the statute book with properly resourced and independent monitoring, benefitting disabled people throughout the UK.
